Outcoach Privacy Policy

This Privacy Policy applies to the use of the products and services (‘services’) provided by Outcoach Pty Ltd ('Company', 'we', 'us', or 'our'). We are committed to protecting your privacy at Outcoach. This policy describes how we may collect, store, and use (‘process’) your information when you use our services, such as when you visit our website which has the domain https://www.outcoach.io or use our mobile or web application. By utilising our services, you agree that you have read, understood, and agree to be bound by this Privacy Policy and consent to the collection of the information described below. If you do not agree to this Agreement, then you may not use the Application.

What is personal information?

“Personal information” is any information about an individual which allows that individual to be identified from that information, or reasonably identifiable due to that information. In general terms, this includes information which personally identifies you either directly (e.g. your name) or indirectly. 

What information we collect from you?

The personal information we collect from you depends on the context of your use of our services and what information you choose to provide to us. When you register an account for Outcoach’s services, we may personal information about you so that we can provide you with our services, including the following:

  1. Full name

  2. Date of birth

  3. Phone number

  4. Email address

  5. Emergency contact name and phone number

  6. Injuries

  7. Allergies

  8. Contact or authentication data

When a club is created within our application, we may collect information about the club such as the club name, address, ABN (for making invoices).  

Payment Data:

We may collect data that is needed to process your payment. However, we do not process any of your payments on our servers, but rather use third party payment processing services such as Stripe and PayPal. You can find their respective Privacy Policies here:

Google account registration & Login:

We offer you the ability to register and log in using your third-party Google account details. When you do this, we may receive certain profile information from Google about your Google Account, including your name, email address, and profile picture. We will only use this information for the purposes articulated in this policy or that we otherwise make clear to you through our services. Please note that we do not control and are not responsible for other uses of your personal information by Google. We recommend you review their privacy notice to understand how they collect and process your data. 

 

Application Data:

If you use our application, we may also collect the following information from you with your permission:

    • Mobile device access. We may request access to use certain features of your mobile device, including the camera, phone, files, system, push notification.

 

Other information collected:

To assist you with good service and support and maintain further improvements we process data, such as:

  1. Analytics data about your use of the service

  2. Cookie data

  3. Information about your mobile device (device identifier, operating system, manufacturer, IP address)

We also collect certain information when you use our services, which does not reveal your specific identity but may reveal your device and usage information, such as your IP address, browser data, device data, language preferences, and other technical information. This information is needed primarily for the security and operation of our services and analytics.

How do we use/process your information

We process your information for the purpose of providing and improving our services, as well as for security reasons and to comply with the law. If we process your information for other purposes, we will only do this with your prior consent. Some examples of how we process your information are as follows:

  1. Account creation and authentication. As discussed above, we may process personal information as such as full name and email to create your account and ensure you get access into the mobile and web application

  2. We may process your information to respond to user inquiries and offer support to you and other users

  3. To send administrative information to you

  4. To request feedback

  5. To send you marketing communications. However, please note that you can opt out of our marketing emails at any time

  6. To measure the effectiveness of marketing campaigns 

  7. To identify usage trends

  8. To provide you our services via our mobile and web application. We process your information so that we can provide you with the multiple features and functionalities of our application (e.g., scheduling, communication, invoicing, payments, reflection).

We only process your personal information when we believe it is necessary for us to do so and if we have a valid legal basis, including with your consent, compliance with applicable law, to provide you with our services, to protect your rights, and to fulfill our legitimate business interests. 

 

Sharing your data with third parties

We may need to share your information with third parties who process data on our behalf, as such as server hosting providers, data storage providers, customer support, payment processing platforms and analytics systems. These third parties may be located in countries other than your country, therefore, your data may be subject to privacy laws that are different from the ones in your country.

We may also disclose your personal information to regulatory authorities if there has been an alleged criminal offence or breach of the Terms and Conditions or where Outcoach is under a duty to disclose your information to comply with legal obligations.

Outcoach’s services may display links to and from the websites of third parties. Please note that these websites have their own privacy policies and that if you follow a link to any of these websites, then we do not have any responsibility or liability, under any circumstances, for these websites. Please check these websites’ policies before you submit any personal information to these websites.

 

Security

Outcoach will strive to take all reasonable steps to ensure your information is processed securely and in accordance with this Privacy Policy. However, the transmission of information via the internet (including email) is not completely secure. Though we will do our best to protect your information and use strict security features to prevent unauthorised access to data, we cannot guarantee the security of any information transmitted over the internet. Any transmission is at your own risk.

Accessing, modifying & deleting your information

You may access part of your personal information via the web and mobile application, on your Profile section. In the Profile section, you may access, modify, and/or delete your personal information. Alternatively, you may delete your account or you may send us a request to delete it by contacting us via https://www.outcoach.io/contact. Please note that you will only be able to use our application if you have an account with us. 

How long do we keep your data

Please note that we keep your information for as long as necessary to fulfill the purposes of collecting, keeping, and using your information, such as providing our service to you, security reasons, and complying with the law. Therefore, we may keep your personal information till after you have deleted your account, however, we will only keep your personal information for a reasonable reason and for a reasonable time.

Governing Law and Jurisdiction

This Privacy Policy and any related actions will be construed and governed according to the laws of the Commonwealth of Australia and the State of Victoria. You agree that any disputes arising with us shall be settled in the Australian court system. 

If any dispute arises, both Parties shall use their best efforts to resolve their dispute(s) arising from these Terms by first attempting to informally negotiation any dispute for at least 90 days upon written notice from one Party to the other Party. After the 90 days, the Parties shall use their best efforts to resolve the dispute via arbitration. The legal place of the arbitration shall be Melbourne, Australia. The governing law of the contract shall be the law of the Commonwealth of Australia and the State of Victoria. 

Changes to our Privacy Policy

We reserve the right to modify or change this Privacy Policy, at any time and for any reason. We will notify you of any changes to this policy via the mobile application, web application, website, or email.
